TERMS OF SERVICE

WakeRule is an alarm app whose alarm stops only when your phone confirms you completed a task you set. These Terms are the agreement between you and NEXARLABS LTD, a company registered in England and Wales ("we," "us"), for using the WakeRule app and website. By creating an account or using WakeRule, you agree to them. If you do not agree, do not use WakeRule. Your privacy is covered separately in our Privacy Policy.

The short version

WakeRule makes your alarm harder to dismiss — it does not make it more reliable. It cannot promise the alarm will fire or that you will wake up, so do not rely on it as your only alarm for anything that matters. Running a camera-verified mission needs a paid subscription, billed and managed by Google Play; you can cancel any time in Google Play. Only submit tasks that are safe, legal, and yours to perform.

1. Eligibility

WakeRule is for adults. You must be at least 18 years old to use it, and by using WakeRule you confirm that you are. WakeRule is listed on Google Play with an "18 and over" target audience and minor access restricted. If we learn that an account belongs to someone under 18, we will close it.

2. What WakeRule is — and is not

When an alarm rings, WakeRule asks you to complete a task you chose when you saved the alarm. For a camera task, your phone records short video clips (or, in an older mode, captures short bursts of frames) and sends them to Google's Vertex AI to check the task was done. For a spoken task, your phone listens locally. The alarm stops when the task is confirmed.

WakeRule is not a security, identity, or liveness check, and does not claim to be. It does not verify who you are, only that the requested action appears to have happened in front of the camera. It is not a medical device and makes no clinical or sleep-disorder claims. Do not use it to diagnose, treat, or manage any health condition.

3. No guarantee it wakes you (important)

WakeRule depends on your phone, its operating system, its manufacturer's power and background restrictions, its volume and Do-Not-Disturb settings, and the permissions you grant. Any of these can prevent an alarm from ringing, showing full-screen, or being heard. If the full-screen-alarm permission is not granted, an alarm can degrade to a brief on-screen notification instead of taking over the screen.

We do not and cannot guarantee that an alarm will fire, that it will be loud enough or long enough to wake you, or that verification will succeed. Do not rely on WakeRule as your sole means of waking for anything where oversleeping could cause harm, loss, or danger — including work, travel, medication, childcare, or safety-critical duties. Keep an independent backup alarm.

You understand and accept the risk of relying on WakeRule to wake you, and you are solely responsible for how you respond to — or fail to respond to — any alarm or verification result. WakeRule is a convenience layered on your phone's alarm, not a life-safety, medical, or safety-critical device. This section must be read together with the "as is" disclaimer (Section 11) and the limitation of liability (Section 12).

4. Acceptable use

You are responsible for the tasks you submit. You may only ask WakeRule to verify an action that one person can safely and lawfully perform in front of a camera. When you create a mission, our compiler attempts to reject instructions that are unsafe, sexual, violent, self-harming, illegal, that require private or personal information, or that require more than one person, and returns a reason you can edit. This filter is a best-effort safeguard, not a guarantee; you must not attempt to use WakeRule for any of the following, whether or not the filter catches it:

  • Anything unsafe, physically dangerous, self-harming, or that could injure you or others.
  • Anything sexual, violent, harassing, hateful, or illegal.
  • Tasks that require another identifiable person, or that capture someone who has not consented to being on camera.
  • Submitting other people's personal, private, or confidential information in your task text or on camera.
  • Attempting to defeat, reverse-engineer, overload, or probe the service, or to use it for identity or liveness verification.

5. Your content

Your mission text and the camera video and frames captured while you complete a task are your content. You keep ownership of it. You grant us the limited license needed to operate the service on your behalf — to store your mission text, compile it into checkpoints, and send your mission text and camera video and frames to Google's Vertex AI to verify the task. We do not use your content to train any model, and we do not sell it. You are responsible for ensuring you have the right to submit whatever appears in your task text or on camera. How this data is handled and retained is described in the Privacy Policy.

6. Accounts

AI-verified missions require an account, created by signing in with Google. You are responsible for keeping access to your Google account secure and for activity under your WakeRule account. One account is for one person; do not share it. A single email and password account also exists solely so that a Google Play reviewer without a Google account can sign in to review the app; its password is stored only as a one-way hash.

7. Subscriptions and billing

Running an AI-verified (camera) mission requires an active paid subscription. Without one, an alarm still rings, but the task is not AI-verified. Subscription options are US$9.99 / month and US$89.99 / year, shown in your local currency at the price Google Play sets for your region. There is no free trial.

Subscriptions are sold and billed by Google Play, which is the merchant of record. You pay Google, not us, and you enter your payment details directly into Google Play — we never see or handle your card or payment information. Subscriptions renew automatically for the same period at the then-current price until you cancel. By subscribing, you authorize Google Play to charge your payment method on each renewal.

The price shown to you in the app and in Google Play at the moment you subscribe is the price that applies. If a figure above ever differs from what Google Play shows you, the Google Play price governs.

8. Cancellation and refunds

You can cancel any time in Google Play (Play Store → Subscriptions). Cancellation turns off auto-renewal; your access continues until the end of the period you have already paid for, then stops. Refunds, where available, are handled by Google Play under Google's refund policies, not by us. Deleting your WakeRule account does not cancel your Google Play subscription and is not a refund — you must cancel the subscription separately in Google Play, or you may continue to be charged.

9. Third-party services

WakeRule relies on Google services — Google Vertex AI (Gemini) to compile and verify tasks, Google Sign-In for accounts, and Google Play for billing. Your use of those services through WakeRule is also subject to Google's applicable terms and policies. We are not responsible for third-party services, and their availability is outside our control.

10. Intellectual property

The WakeRule app, website, name, and design are owned by NEXARLABS LTD and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use WakeRule for its intended purpose. You may not copy, modify, distribute, sell, or reverse-engineer the app except as the law expressly permits.

11. Disclaimer of warranties

WakeRule is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, that alarms will fire, that verification will be accurate, or that it will meet your requirements. See Section 3.

12. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under the law of your country of residence.

Subject to the paragraph above, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, or for any loss arising from an alarm that fails to fire, is delayed, is not loud enough, or is not heard, or from a verification result that is wrong.

Subject to the first paragraph above, our total liability for all claims relating to WakeRule in any 12-month period will not exceed the greater of (i) the total amount you paid for your WakeRule subscription in that period or (ii) US$100. Because your subscription is billed by Google Play rather than by us, a fixed floor is stated so this limit is meaningful.

Nothing in this section limits our liability for gross negligence or willful misconduct, and if you are a consumer, this section does not affect your statutory rights or any liability that cannot be limited under the consumer-protection law of your country of residence. If any part of this section is unenforceable where you live, the rest still applies.

13. Indemnification

You agree to indemnify and hold harmless NEXARLABS LTD and its officers, employees, and agents from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of or relating to: (a) your mission text or anything captured on camera while you use WakeRule, including any person captured without their consent; (b) your breach of these terms or the Acceptable Use section; or (c) your violation of any law or the rights of any third party. This does not apply to any claim to the extent it arises from our own negligence or breach, and nothing here requires you to indemnify us for any liability that cannot be shifted to a consumer under the law of your country of residence.

This section does not apply to consumers resident in the United Kingdom, the European Union, or the European Economic Area. If you are a consumer in those territories, you are liable to us only as the general law provides, and nothing in this section adds to that.

14. Suspension and termination

You may stop using WakeRule and delete your account at any time (see the Privacy Policy for what deletion does). We may suspend or terminate access if you breach these terms or use the service unlawfully or in a way that harms the service or other people. Sections that by their nature should survive — including content responsibility, disclaimers, limitation of liability, and governing law — survive termination.

15. Changes to these terms and the service

We may update these terms as the service changes, and we may change or discontinue features. When we make material changes we will revise the "Last updated" date and, where appropriate, notify you. Continuing to use WakeRule after a change means you accept the updated terms.

16. Governing law and disputes

These terms are governed by the law of England and Wales, except that if you are a consumer you keep the protection of any mandatory consumer-protection laws of your country of habitual residence, and nothing here removes that protection.

If you are in the United States: you and we agree to resolve disputes by individual, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, and you waive participation in any class or collective proceeding. This arbitration agreement is governed by the Federal Arbitration Act. You may bring a qualifying claim in small-claims court instead, and you may opt out of arbitration by emailing [email protected] within 30 days of first accepting these terms — opting out costs you nothing and does not affect your use of WakeRule.

If you are in the EU, the UK, or elsewhere: nothing above forces you into arbitration. You may bring proceedings in the competent courts, including the courts of your home country, and you may use any alternative-dispute-resolution scheme available to you where you live. The courts of England and Wales have jurisdiction over any dispute we bring, without affecting your right as a consumer to sue, and be sued, in the courts of your own country.
